Die KoPart eG ist eine Genossenschaft, die ihre Mitglieder, insbesondere die Städte und Gemeinden in NRW, bei der Beschaffung unterstützt. Vorliegend schreibt sie für interessierte Mitglieder einen Rahmenvertrag zum Dienstfahrrad-Leasing aus. Dadurch sollen die positiven Auswirkungen von gesundheitsförderndem Radfahren unterstützt und den kommunalen Tarifbeschäftigten ein stress- und staufreien Arbeitsweg ermöglicht werden. Dazu bieten ihnen die kommunalen Arbeitgeber künftig die Möglichkeit, monatliche Entgeltbestandteile zum Zwecke des Leasings von straßenverkehrstauglichen Fahrrädern gemäß § 63a StVZO sowie leasingfähigem Fahrradzubehör umzuwandeln. Es wird Bezug genommen auf den Tarifvertrag zur Entgeltumwandlung zum Zwecke des Leasings von Fahrrädern im kommunalen öffentlichen Dienst (TV-Fahrradleasing) vom 25. Oktober 2020 (Anlage 1). Mit dem Zuschlag im Vergabeverfahren zur Ausschreibung eines Rahmenvertrags für Leasingverträge von Dienstfahrrädern kommt zwischen der KoPart eG einerseits und dem Auftragnehmer diese Rahmenvereinbarung zustande.
